These Terms form a legally binding agreement between C+ INFINITY (“we”, “us”, “our”) and the User (“you”, “your”). By using our website or services, you agree to these terms.
1. Age & Legal Responsibility
• Age Limit: You guarantee that you are of legal smoking age under the laws of Hong Kong Special Administrative Region (“HKSAR”), which is strictly 18 years of age or older. We may ask for valid ID at any time.
• Compliance: You are solely responsible for verifying and following with all applicable laws and regulations within HKSAR.
• Limitation of Liability: We are not responsible for any legal issues, customs seizures, fines, or penalties if you violate the laws of HKSAR.
2. Website Information & Errors
• As-Is Content: Product images and descriptions are for reference only. The actual physical product rules.
• Error Correction: We reserve the right to correct website errors or typos at any time. We can cancel or refuse any order affected by mistake, even if payment was already processed.
• Language: These Terms are governed exclusively by Hong Kong (HKSAR) law and courts. The English version is the only legally binding text.
3. Orders & Cancellations
• Order Acceptance: Placing an order is an offer to buy. We reserve the absolute right to reject or cancel any order for any reason before shipping.
• Our Cancellations: If we cancel your order, you will receive a full refund as your sole remedy.
• Your Cancellations: If you request to cancel an order (via email or Whatsapp) before it ships, we will deduct a 20% administrative fee from your refund.
4. Payment & Taxes
• Authorization: You authorize us to charge your payment method at the time of purchase.
• Dispute First: You agree to contact our customer service to resolve billing issues before filing a chargeback with your bank. Abusive or fraudulent chargebacks will result in immediate account termination.
5. Shipping & Customs
• Timelines: Orders with confirmed successful payment will generally be shipped within 1–3 business days (up to 7 business days during peak seasons).
• Transfer of Risk: Risk of loss or damage passes entirely to you the moment the package is signed for at your delivery address.
• Address Errors: You must provide accurate address details. We are not liable for lost or delayed packages due to incorrect addresses.
• Lawful Inspections: Authorities may open and inspect packages. We only ship brand-new items and are not responsible for packaging damage or broken seals caused by lawful regulatory inspections.
6. Claims, Damage, & Returns
• Damage Claims: If items are damaged during transit, you must email [email protected] within 24 hours of delivery. You must provide a continuous, unedited unboxing video to receive a replacement or refund.
• Redelivery Fee: If a package returns to us due to your wrong address or a failure to collect it, you must pay a minimum fee of HKD 100 (or the actual courier cost, whichever is higher) to ship it again.
• Strict No-Refund Rule For:
o Incorrect shipping addresses.
o Product spoilage or damage due to improper storage after delivery.
o Subjective tastes, flavors, aromas, or minor cosmetic packaging flaws.
o Condition issues inside factory-sealed boxes, unless you explicitly requested a pre-shipment inspection.
7. Customer Conduct & Fraud
• Anti-Defamation: You agree to contact customer service to resolve disputes privately first. If you post false or defamatory statements about us online or on social media without exhausting our private resolution process, we will permanently terminate your account and reserve the right to sue.
• Fraud Prevention: We will cancel orders, freeze accounts, and report data to law enforcement if we suspect financial fraud, identity theft, or unauthorized payment use.
8. Legal & General Terms
• Intellectual Property: All text, images, logos, and code on our website are owned by or licensed to us.
• No Consequential Damages: To the maximum extent under HKSAR law, we are not liable for any indirect losses, loss of profits, or delays caused by events outside our control (Force Majeure, weather, strikes, etc.).
• Governing Law: These terms are governed exclusively by Hong Kong (HKSAR) law, and all disputes must be handled strictly by the courts of Hong Kong.
• Amendments: We can update these Terms at any time. Buying from us means you accept the revised rules.

2. 網站資訊與免責聲明

• 錯誤修正權利： 本公司保留隨時修正網站任何錯誤、遺漏或排版錯誤之權利。凡受前述錯誤影響之訂單，即使已完成付款程式，本公司仍保留絕對之權利予以取消或拒絕。

3. 訂單提交與取消條款
• 要約引言： 您經由本網站提交訂單僅構成購買商品之單方要約，對本公司不具約束力。本公司保留在貨物實際發貨前，因任何原因拒絕、縮減或取消任何訂單之絕對之酌情權。
• 本公司取消訂單： 凡依本條款由本公司取消之訂單，本公司將退還已收取的款項。
• 用戶申請取消訂單： 若您在貨物發貨前以書面形式（電子郵件或Whatsapp）申請取消訂單，本公司有權從您的總訂單金額中扣除百分之二十（20%）作為行政費用。
4. 財務條款與稅務義務
• 付款授權： 當您提交訂單時，即代表您明確表示授權本公司（或本公司指定之協力廠商支付處理商）自您所選之付款方式中扣除交易之全額款項。
• 爭議處理程式： 您同意並承諾，在向您的發卡銀行或金融機構提出任何正式爭議、拒付（Chargeback）或撤銷請求之前，必須先與本公司之客戶服務部聯絡以尋求解決。凡涉惡意拒付或未遵循此爭議處理程式者，本公司有權立即終止您的帳戶。
5. 運輸物流與風險轉移
• 發貨時效： 經確認付款成功後，貨物通常會於 1 至 3 個工作天內安排發貨（如遇物流旺季，發貨時效可能延長至 7 個工作天）。
• 風險轉移： 當貨物由您、您的代理人或送貨地址之收件人簽收時，即視為交付完成。自該時起，貨物之毀損、丟失或損壞之風險即完全移轉由您承擔。
• 地址錯誤責任： 您必須提供精確、完整且有效之送貨地址。若因您提供之地址不正確、不完整或失效而導致配送失敗、物流延誤或退回發貨地，本公司概不承擔任何法律責任。
• 海關檢查：針對香港特區以外之配送，您所屬地之政府機關可能依法開箱查驗貨物。本公司保證所有出貨商品於交付承運人前均為全新狀態，對於因相關官員執法所導致之包裝損壞、外觀變更或封條破損，本公司概不負責。
6. 索賠限制、損壞及退換貨條件
• 索賠時效： 若貨物於運輸途中遭受損壞，您必須於簽收後 24 小時之內，將索賠請求發送至 [email protected]。提出索賠時，必須檢附一段連續且未經剪輯之完整開箱影片作為證據，否則不予受理。
• 重寄與退回物流費： 若貨物因您提供之地址錯誤或未按時領取而被退回本公司，您須承擔回程及再次派送之一切物流費用。每次派送將加收最低 HKD 100 之物流費（或按快遞公司之實際收費，以較高者為準）。
• 嚴格不予退款或更換之情形：
o 因您提供錯誤地址，而導致的包裹延誤或遺失。
o 貨物交付完成後，因您存放不當或環境因素所導致之產品變質或損壞。
o 基於您個人主觀偏好（包括但不限於口感、風味、香氣等）或包裝上微小外觀瑕疵。
o 原廠密封（Sealed）包裝內部之商品狀況問題，若您於發貨前已明確要求本公司拆封檢查者不在此限。
7. 用戶行為規範與欺詐防制
• 禁止公然誹謗： 您同意秉持誠信原則，必須首先與客戶服務部進行協商。若您未先尋求協商，即於協力廠商平臺、社交媒體或公開論壇發布任何虛假、具誤導性、惡意或誹謗本公司商譽之言論，本公司保留立即 unilateral（單方面）終止您帳戶之權利，並保留追究法律訴訟權利。
• 欺詐預防措施： 本公司有權針對任何涉嫌欺詐、冒用身份、未經授權使用他人信用卡等違法交易行為進行調查，亦有權在不事先通知的情況下，拒絕交易、凍結帳戶並移送司法機關。
8. 法律管轄及一般條款
• 知識產權： 本網站所包含之所有文字、代碼、圖像、商標及著作物，均屬本公司所有或已獲得合法授權，受知識產權法之保護。
• 間接損失之豁免： 在香港特區法律允許的最大範圍內，本公司對於因不可抗力事件（包括天災、罷工、政府封鎖、颱風或黑雨警告、網絡中斷）或協力廠商供應商錯誤所導致之任何間接損害、附隨損害、利潤損失或業務中斷，概不承擔任何賠償責任。
• 專屬管轄法院： 本條款之解釋與爭議解決均受香港特區法律管轄。任何因本條款、網站使用或買賣法律關係所引起之訴訟、糾紛或爭議，均應受香港特別行政區法院管轄，並按其詮釋。
